Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Turnaworks (“we”, “us”) about the BuildUp mobile game (“the app”). By downloading or playing the app, you accept them. If you do not accept them, do not use the app.

1. Who may use the app

You must be at least 13 years old, or the minimum age of digital consent where you live if that is higher (16 in some parts of the EU). If you are under the age of majority, you may only use the app with the involvement of a parent or guardian, who accepts these Terms on your behalf.

2. Your licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on Apple-branded devices you own or control, for your own non-commercial entertainment, in line with the App Store Terms of Service. We keep every right we do not expressly grant you here.

3. Purchases

• The app may offer optional in-app purchases, such as visual themes or the removal of advertising. They are cosmetic or convenience items — they do not change the rules of the game.
• All purchases are processed by Apple through your Apple Account. We never see or handle your payment details.
• In-app items are a licence to use them inside the app, not property. They have no monetary value, cannot be transferred or exchanged, and cannot be redeemed for cash.
• Purchases are tied to your Apple Account, not to a device. Reinstalling and tapping Restore Purchases brings back what you bought.
• Refunds are handled by Apple, under Apple's policy, at reportaproblem.apple.com. We cannot issue refunds for App Store purchases ourselves. Nothing here affects the statutory rights consumers have in their own country.
• Prices and the items on offer may change. Any change applies to future purchases, never to something you have already bought.

4. Advertising

The app may show optional advertisements that you choose to watch in exchange for an in-game reward. We are not responsible for the content of third-party advertisements or for anything you do after following one.

5. Progress and data

Your progress is saved on your device. Deleting the app, resetting progress, or losing the device will lose it. Achievements and scores reported to Game Center are stored by Apple with your Apple Account. We are not able to restore lost local progress.

6. Things you agree not to do

• Reverse engineer, decompile or disassemble the app, except where the law expressly permits it
• Modify the app, or use tools, bots or modified clients to alter scores, achievements or purchases
• Submit falsified scores to leaderboards, or otherwise interfere with fair play for others
• Copy, sell, rent or redistribute the app or any part of it
• Use the app to break the law, or in any way that damages, disables or overburdens the services it depends on

We may limit or end your access to online features, including leaderboards, if you do any of these.

7. Intellectual property

The app — its code, artwork, models, music, sound and the name BuildUp — belongs to us and is protected by copyright and other laws. These Terms give you a licence to play, and nothing more. All trademarks belonging to others are the property of their owners.

8. Third-party services

The app relies on services operated by others, including Apple (App Store and Game Center), Google (Firebase), RevenueCat and Meta. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for services we do not operate, and they may change or become unavailable independently of us.

9. Availability and changes

We may update, change or stop offering the app or any of its features at any time. We may add, remove or alter content, including themes and achievements. We are not obliged to keep any particular feature available.

10. Disclaimer of warranties

The app is provided “as is” and “as available”, without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost game progress, arising out of your use of the app. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or US$50.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the mandatory rights given to you by the law of your country of residence.

12. Apple

Because you obtained the app from the App Store, the following applies and overrides anything inconsistent elsewhere in these Terms:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
• Apple has no obligation to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
• Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

13. Termination

These Terms apply for as long as you use the app. You can end them at any time by deleting the app. We may suspend or end your licence if you materially breach these Terms. Sections that by their nature should survive — intellectual property, disclaimers, limitation of liability and governing law — survive termination.

14. Governing law

These Terms are governed by the laws of Türkiye, without regard to conflict of law rules, and the courts of Istanbul, Türkiye have jurisdiction. If you are a consumer resident in the EU, the UK or another jurisdiction whose law grants you the right to bring proceedings locally, that right is unaffected.

15. Changes to these Terms

If these Terms change, the new version will be posted here with a new date at the top. Continuing to use the app after a change means you accept the updated Terms.
